Day Spa Operations Pty Ltd (ABN 76 634 548 075) and its related companies (“Aqua Vitae”, “we”, “us”, “our”) values and respects the privacy of the people we deal with. Aqua Vitae is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.   • visit or shop with us at our spas;
  • visit the websites of us and our related companies (together, our “websites”);

  • otherwise engage in with us such as when you make an enquiry or contact us, or participate in a survey, promotion or competition.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. The personal information we collect about you depends on the nature of your dealings with us or what you choose to share with us. Examples of Personal Information we collect includes (but is not limited to) names, addresses, email addresses and phone numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our websites and from other publicly available sources. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you and marketing. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

Under certain circumstances, Aqua Vitae may need to collect sensitive information about you. This might include health information.

If we collect your sensitive information, we will only use this for the primary purpose for which it was obtained, if it is necessary to prevent a serious and imminent threat to life or health, or as otherwise required by law, and we take appropriate measures to protect the security of this information.

In-store surveillance

Our spas and company properties have video surveillance cameras that monitor and help to facilitate the safety and security of those premises, our team members, customers and other members of the public. We do not share these recordings with any third parties except where we are required to by law. Cameras are never placed in areas of our premises that would unreasonably intrude on the privacy of individuals.

Disclosure of personal information to third parties

We may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose your information in order to provide our service to you (such as our IT providers, payment processors, marketing providers, shipping providers) or otherwise required or compelled by law.

Security of Personal Information

We take measures to ensure your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

We will also take measures to help keep your personal information accurate and up-to-date. If we no longer need your personal information, we will destroy or de-identify it.

As a merchant, we are required to comply with the Payment Card Industry Data Security Standard (PCI DSS) which is an information security standard for organisations that handle credit or debit card data. This means that when you shop with us, both in-store and online, and we store your credit or debit card details, we are required to use secure processes such as encryption and tokenisation. But you should still exercise caution when shopping online, and never enter any credit or debit card details when contacting us via email or through our website “Contact Us” form as in these instances those details will not be guaranteed protection.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

We will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.
